1. Acceptance of Terms

These Terms of Service ("Terms") are a legal agreement between you and Velo ("we," "us," or "our"). By downloading, installing, or using the Velo application or website (collectively, the "Service"), you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 13 years old (or 16 in the EEA) to use the Service. By creating an account, you represent that you meet this age requirement and that the information you provide is accurate.

We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service on devices you own or control, for personal, non-commercial reading purposes.

5.1 Ownership

You retain all ownership rights to the documents (EPUB, PDF) you import into Velo and any content you create (notes, highlights, bookmarks). We claim no intellectual property rights over your content.

5.2 Your Responsibilities

You represent and warrant that you have the legal right to access and read any document you import into Velo. You are solely responsible for ensuring your use of imported content complies with applicable copyright and intellectual property laws.

5.3 Limited License to Us

By uploading documents to the cloud library, you grant us a limited license to store, transmit, and cache those files solely for the purpose of providing the sync and cloud library features to you. We do not read, index, analyze, or share the content of your files.

5.4 Content Removal

We reserve the right to remove content from our servers if we receive a valid legal complaint (see Section 6 below) or if storage of the content poses a security risk. We will make reasonable efforts to notify you before removal.

We respect the intellectual property rights of others. If you believe content hosted on our Service infringes your copyright, you may submit a notice under the Digital Millennium Copyright Act (DMCA) to:

7. Intellectual Property

Velo, including its name, logo, design, code, animations, and documentation, is owned by us and protected by copyright, trademark, and other intellectual property laws. Nothing in these Terms grants you any right to use our trademarks or branding without prior written consent.

8. Subscriptions & Payments

8.1 Free & Paid Tiers

Velo may offer both free and paid subscription tiers. Paid features, pricing, and billing intervals will be clearly presented before purchase.

8.2 App Store Purchases

If you purchase a subscription through the Apple App Store, the transaction is processed by Apple. Apple's terms and payment policies apply to all in-app purchases. We do not have access to your payment card details.

8.3 Auto-Renewal

Subscriptions auto-renew unless you cancel at least 24 hours before the end of the current billing period. You can manage or cancel subscriptions in your device's Settings > Apple ID > Subscriptions.

8.4 Price Changes

We may change subscription prices. Price changes take effect at the start of your next billing period after notice. If you do not agree with a price change, you may cancel before it takes effect.

9. Support, Refunds & Cancellation

9.2 Refund Policy — App Store Purchases

All in-app purchases and subscriptions made through the Apple App Store are subject to Apple's refund policy. To request a refund for an App Store purchase:

9.3 Refund Policy — Direct Purchases

If we offer any purchases outside the App Store in the future, the following policy applies:

You may cancel your subscription or delete your account at any time.

9.5 Service Interruptions

If the Service experiences a significant outage (more than 72 consecutive hours) affecting paid features, we will extend your subscription by the duration of the outage at no cost, or provide a pro-rata refund upon request.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. WE DISCLAIM ALL WARRANTIES INCLUDING, WITHOUT LIMITATION, WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, secure, or compatible with all devices or file formats. Reading speed improvements described on our website and marketing materials are based on published research and are not guaranteed for every individual.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL VELO BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF READING PROGRESS, LOSS OF PROFITS, OR BUSINESS INTERRUPTION.

OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability. In those jurisdictions, the above limitations apply to the fullest extent permitted by law.

You agree to indemnify and hold harmless Velo and its officers, employees, and agents from any claims, losses, or damages (including legal fees) arising from your use of the Service, your violation of these Terms, or your infringement of any third-party rights.

These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles.

Before filing a formal claim, you agree to contact us at hello@veloreader.com and attempt to resolve the dispute informally for at least 30 days. If we cannot resolve the dispute informally, either party may pursue resolution in the state or federal courts located in San Francisco County, California.

You agree to resolve disputes with us on an individual basis. You waive any right to participate in a class action or class-wide arbitration.

We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date and notify you by email or through the app at least 14 days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the revised Terms.
